Participation Agreement

What Coaching Is

Coaching is a collaborative process designed to support the development of personal, professional, or business goals and to develop strategies for achieving them. It is not therapy, medical advice, or legal advice, and does not substitute for any of these.

1. Coach-Participant Relationship

A) The Participant is solely responsible for their own wellbeing, decisions, choices, actions, and results arising from the coaching relationship. The Coach is not liable for any direct or indirect result of services provided.

B) Coaching is not therapy and does not diagnose, prevent, cure, or treat any mental disorder, medical condition, or addiction. If the Participant requires therapeutic support, they are encouraged to seek it from an appropriately qualified professional.

C) This cohort is specifically focused on ADHD experience. The Coach draws on lived experience and coaching frameworks, not clinical assessment or diagnosis.

2. Services

A) This agreement covers participation in a group coaching cohort consisting of 6 sessions held weekly via Zoom, at a time communicated in advance. Each session is scheduled for 90 minutes, structured as approximately 60 minutes of coached content followed by open Q&A. The Coach reserves the right to adjust this structure where necessary. Each session covers a pre-set topic; a session outline will be provided to participants separately. The Coach reserves the right to adjust topics where necessary.

B) The fee for participation in this cohort is £450, payable in full at the time of sign-up. If a promotional or referral code has been applied, the adjusted amount shown at checkout reflects the fee payable. Fees are non-refundable once the cohort has commenced, except at the Coach's discretion.

C) Sessions run at a fixed time each week. There are no reschedules or alternative sessions. If a Participant is unable to attend a session, that session is missed. The Coach will endeavour to provide at least 24 hours' notice of any cancellation or change on their part.

D) Either party may withdraw from the cohort at any time. The Participant is encouraged to have a brief conversation with the Coach if withdrawing, but this is not required.

E) The Coach reserves the right to ask a Participant to leave the cohort if, in the Coach's reasonable judgement, the Participant is not suitable for group coaching at this time, or if their behaviour is disruptive to other participants. Where possible, this will be discussed with the Participant privately before any decision is made.

3. Confidentiality

A) All content shared within cohort sessions is confidential. Participants are asked not to share the personal disclosures of other cohort members outside the group. The Coach cannot be held responsible for breaches of confidentiality by other cohort participants.

B) The Coach is bound by the principles of confidentiality in the AC Code of Ethics. The coaching relationship is not a legally privileged relationship.

C) Sessions will be recorded by the Coach for their own professional development and learning purposes only. Recordings will not be shared with any third party, nor published in any form. Participants will be informed at the start of each session that recording is active and may withdraw consent at any time - in which case the Coach will stop recording for the duration of that session.

D) The Coach may discuss anonymised session content with their coaching supervisor without the Participant's presence. The Coach will take reasonable steps to protect participant identity in all such discussions.

E) Any feedback or testimonials provided by the Participant will not be used publicly in identifiable form without prior written permission from the Participant.

4. Safeguarding

A) The Coach is committed to the safety and wellbeing of all cohort participants. All information shared within the coaching relationship is treated as confidential. However, confidentiality may be broken without consent where the Coach believes there is a serious risk of harm to the Participant or others, or where the Coach is required to do so by law - including but not limited to disclosure of serious criminal activity. In such circumstances the Coach may contact the emergency contact provided at onboarding and/or notify relevant authorities. The Coach will inform the Participant before taking such action wherever it is safe and practicable to do so.

B) The Coach will signpost Participants to appropriate support services where relevant. A list of relevant resources will be made available at the start of the cohort.

5. Data Protection

A) The Coach is registered with the Information Commissioner's Office (ICO) as a data controller and processes personal data in accordance with UK GDPR.

B) The personal data collected includes name, email address, emergency contact details, and session recordings. This data is collected for the purpose of delivering the coaching cohort and the Coach's professional development. By providing emergency contact details, the Participant confirms that they have informed their nominated emergency contact that their details are being shared with the Coach for safeguarding purposes.

C) Sessions are conducted via Zoom. Zoom acts as a third party data processor in the delivery of this service and participants' data may be processed by Zoom in accordance with their own privacy policy. The Coach will not use Zoom data for any purpose beyond session delivery.

D) Personal data will not be shared with any third party except where required by law or where necessary under the safeguarding provisions of this Agreement. Session recordings will be stored securely and deleted within 12 months of the cohort ending, unless the Participant requests earlier deletion.

E) Participants have the right to access, correct, or request deletion of their personal data at any time by contacting the Coach directly.

6. Professional Insurance

The Coach holds public liability insurance appropriate to the provision of coaching services.

7. Limitation of Liability

A) The Coach makes no guarantees regarding outcomes. In no event will the Coach be liable for any indirect, consequential, or special damages arising from participation in this cohort.

B) This Agreement represents the entire understanding between the parties. It may not be amended except in writing agreed by both parties.

C) Any dispute arising from this Agreement will first be addressed through good-faith discussion. If unresolved within 30 days, the parties agree to attempt mediation before pursuing legal action.

8. Governing Law

This Agreement is governed by the laws of Scotland and is subject to the exclusive jurisdiction of the Scottish courts.
